SoCal counties ask Supreme Court to dump poop ban

LOS ANGELES (AP) -- The U.S. Supreme Court is being asked to dump Kern County's ban on poop.

Los Angeles and the sanitation districts of Orange County have petitioned the high court to rule on a 2006 ban approved by Kern County voters that would bar them from sending processed human waste there.

Los Angeles and Orange County have continued to dump the sludge, claiming the ban violates federal interstate commerce laws. A federal court had ruled against Kern County, but an appeals court on Tuesday overturned the decision and threw the case back to the lower court.

Los Angeles city has been hauling more than 450,000 tons of biosolids a year to a Kern County farming area for use as fertilizer.

Los Angeles says if the ban is upheld, it would have to spend millions more to truck the waste to Arizona.
